Terms of Service
These Terms of Service govern access to and use of GovPeak, a federal business development and capture management service operated by Gov-Peak, LLC. By creating or using a GovPeak account, you agree to these terms on behalf of yourself and, when applicable, the organization that authorized your use.
If your organization has a signed order form or other written agreement with Gov-Peak, LLC, that agreement controls to the extent it conflicts with these terms.
Accounts and authorized use
You must provide accurate account information, protect your credentials, and use GovPeak only through accounts you are authorized to use. You are responsible for activity performed through your account and for promptly reporting suspected unauthorized access.
An organization may assign roles and permissions to its users. GovPeak may enforce account, workspace, billing, security, or administrative restrictions associated with those roles.
Customer data
You and your organization retain ownership of information you submit to GovPeak. You grant Gov-Peak, LLC the limited rights necessary to host, process, transmit, back up, and display that information to provide, secure, and support the service.
You are responsible for having the rights and authority needed to place information in GovPeak and for deciding what information is appropriate to store or connect to the service.
Federal and third-party information
GovPeak may aggregate or display information from SAM.gov, USAspending, Grants.gov, agency forecasts, and other government or public sources. Those sources can be delayed, incomplete, amended, or unavailable. GovPeak is a business-development aid, not the official source of a solicitation, award, deadline, regulation, or government decision. Users should verify material procurement information with the responsible government source before relying on it.
Third-party products and websites linked or connected to GovPeak are governed by their own terms.
Connected services and AI assistants
You may choose to connect supported third-party services. By connecting a service, you authorize GovPeak to exchange the information and permissions needed for the features you enable.
AI assistant connections are read-only by default. If you expressly grant Read & write access, the assistant may make the limited changes GovPeak exposes for that connection after you request them. GovPeak does not expose delete tools through the AI assistant connection. You can revoke a connection from GovPeak.
You are responsible for reviewing requested actions and for the instructions you give a connected assistant or service.
Acceptable use
You may not use GovPeak to:
- violate applicable law or another person's rights;
- gain unauthorized access to an account, workspace, system, or data;
- introduce malware or intentionally interfere with the service;
- bypass access controls, rate limits, or security measures;
- use another organization's confidential information without authorization; or
- resell or provide access to GovPeak except as permitted by your agreement with Gov-Peak, LLC.
Subscriptions and billing
Paid plans, prices, billing cycles, renewal terms, and any applicable cancellation terms are the terms shown in the order, checkout flow, or other written agreement accepted for the subscription. Failure to pay amounts when due may result in restricted or suspended service consistent with the applicable plan or agreement.
Service operation
Gov-Peak, LLC works to keep GovPeak available and secure, but the service may be interrupted for maintenance, updates, third-party outages, security events, or circumstances outside reasonable control. Features and data sources may change as government systems, connected providers, and GovPeak itself change.
Intellectual property
GovPeak, including its software, design, branding, and original content, is owned by Gov-Peak, LLC or its licensors. These terms do not transfer ownership of GovPeak to you.
Suspension and termination
Gov-Peak, LLC may suspend or limit access when reasonably necessary to address nonpayment, security risk, abuse, legal requirements, or a material violation of these terms. You or your organization may stop using GovPeak subject to the applicable subscription or written agreement.
Disclaimers
To the extent permitted by law, GovPeak is provided without a guarantee that every source, match, recommendation, forecast, or analysis will be complete, current, or error-free. GovPeak does not provide legal, accounting, procurement, or financial advice.
Limitation of liability
To the extent permitted by applicable law, Gov-Peak, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of GovPeak. Any additional or different liability terms in a signed written agreement with Gov-Peak, LLC control over this section.
Changes
Gov-Peak, LLC may update these terms as the service changes. Material changes will be reflected by updating the effective date and, when appropriate, through an additional notice.
